各位好 最近家人想買預售屋，建商給弟弟一本契約（未簽訂，只讓我弟拿回來看） 我看那本似乎是成屋買賣契約 我找了資料，簽訂預售屋買賣契約好像對買方比較好，因為弟弟已下訂（建商還沒動工，所以應該算紅單，可是當初弟弟下訂的證明單中有註明若買方不買，款項全數不退），如果我們簽約那天，告知建商我們想依內政部公佈的預售屋買賣契約為主，若建商不同意，我們能主張退回訂金嗎？ 另外，預售屋契約中的履約保證機制有五種：不動產開發信託、價金返還保證、價金信託、同業連帶擔保、公會連帶擔保 因為找了資料，有提到政府加入此機制，但卻不是完全保證建商會完工交屋，雖然建商會提供興建資金、土地做擔保，若建商真不能完工交屋（烙跑@@），我們真的能拿回所有付出去的工程款及其利息嗎？不會因為某些有優先債權而拿不到錢嗎？ 又想請問，這五種機制可以擇二嗎？還是只能選其中一種？ 如果是各位前輩，不曉得你們會選擇哪種？ 謝謝各位前輩幫忙回答 -- Sent from my Android -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 36.231.18.38
