1.來源：自由新聞網 [連結]： http://www.libertytimes.com.tw/2013/new/nov/26/today-so12.htm 2.內容： 〔記者項程鎮、張文川、林美芬／綜合報導〕 顏姓婦人委託永慶房屋銷售台北市金華街的1.2億元三角窗金店面（見右圖，記者項程鎮攝），以9188萬元成交簽約，後來顏婦反悔不想賣，也不願付仲介費，永慶房屋提告求償，最高法院認為永慶房屋已仲介成功，判決永慶房屋勝訴，顏婦需付367萬元仲介費及利息定讞。 在金店面經營自助餐的顏婦昨表示，當初與房仲簽賣1樓35坪店面，當晚經兒子一講，想清楚「我又不缺錢，幹嘛要賣」，隔天就去解約，後來想賠給買家1%和解，但房仲服務費要4%，她才拒付，「如今法院要這樣判，我也沒辦法，不然能怎樣。」 1名房仲業者表示，該地段1樓店面的物件很少釋出，路口金店面更罕見，100年時，金華街老舊公寓正值都市更新題材發燒之際，又有華光社區開發案、捷運信義線等題材表現，房價看好，屋主可能因此反悔；另1房仲業者則指出，該地段1樓店面目前成交價從每坪200萬到300萬元都有，其實前年9188萬元成交價略微高於行情，若是現在則合理，因屋主是穩定的自營餐廳，沒有租金報酬率考量、也無資金需求，難免惜售。 判決指出，顏婦100年7月22日委託永慶房屋銷售店面，出價1.2億元，雙方簽立銷售委託書，委託期間從100年7月22日到100年8月22日，同年8月12日雙方變更銷售契約，委託價改為9000萬元，顏婦之夫還簽立「服務費（即仲介費）確認單」，同意付367萬元仲介費，隔天李姓男子以9188萬元簽約買下。 屋主︰服務未完成 收費過高 顏婦主張，變更委託價為9000萬元，永慶應以2%收仲介費，簽約隔天她就向買方李姓男子表明不願賣，後來雙方協議解約，因此後續賣屋仲介服務都未進行，永慶想索取367萬元仲介費，顯然收費過高，希望酌減費用；永慶不退讓，堅持如數收取仲介費。 顏婦說，簽約已是晚上12點到凌晨1點，工作很累，當時只是要了解買方出價意願及條件，賣出價格和當初設定的1.2億元差太多。 負責本案的永慶仲介劉錦峰則說，當天簽完買賣契約，顏婦還感謝他說，「賣了這麼久終於成交」，買方也把頭期款匯入履約帳戶，不料屋主又說不賣。 合議庭指出，屋主既然另外簽約同意仲介費為367萬元，就應履約，何況本案房價高，簽約時雙方都有家人陪同，應會謹慎處理，並無急迫輕率情形；本案一、二審皆判永慶勝訴，屋主上訴也遭最高法院駁回。 3.心得與感想： QQ -- Sent from my Android -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 222.251.19.102
