電影票又漲？ 文化部擬抽5%當輔導金 文化部最近想推動電影法修正草案，也就是增加輔導金的資金來源，其中最具爭議的，就 屬從電影票價中提撥5%，消息傳出，讓外界譁然，因為片商跟電影院不可能自行吸收這5% ，很可能就會反應電影票價上，未來一張票恐怕調漲15到20元不等，不過文化部解釋說， 這種電影稅在法國跟韓國早就行之有年，目前都還在規劃當中，但全民買單的模式恐怕不 是人人都能接受。 民眾：「我覺得現在就已經有點貴了，對啊，所以我是覺得不合理。」 民眾大喊不合理，因為電影票恐怕又要再調漲，文化部公文上，找來李烈、馮凱、王小棣 、製片李亞梅，以及導演和電影戲劇公會，要討論輔導金的資金來源，最具爭議的，就屬 這一項，從電影票價中提撥5%。民眾：「我自己可以接受，畢竟幫自己國內的產業吧。」 民眾：「當然對國片好，但是這樣子，也不能打壓別的片子的權益。」 電影「地心引力」：「碰到東西就抓住。」 以珊卓布拉克的電影來說，如果全台賺一億，就會被抽走500萬當國片輔導金，這樣的結 果，片商跟電影院當然不肯自行吸收，為了維護權益，反而把5%轉嫁在票價上，就代表原 本台北東西區的電影票價，會各自從260跟290元，漲到275以及325元以上。 民眾：「我沒有辦法接受，如果要這樣，那就都不要看，然後等網路上來的時候，再去看 就好。」 恐怕還可能減少觀影人潮，但文化部進一步解釋，在法國早就行之有年，他們還徵收11% 的電影票特別增額稅和電視稅，來納入電影基金，韓國也有隨票徵收電影稅，但畢竟各國 民生消費本來就不同，如果為了增加國片輔導金收入，而漲電影票價，這種全民買單的模 式，恐怕不是人人都能接受。 http://news.tvbs.com.tw/entry/506357 -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 59.127.210.162

標題[課業] 法緒 目的性解釋

今天上法緒，老師介紹法律的"目的性解釋" 他說目的性解釋是探求法律的真義，而且是在乎當時立法的目的 他舉的例子是舊民法有規定 妻需冠夫姓，但當事人另有約定者，不在此限 想問一下我對老師的解說的觀念正不正確 老師的意思是說"當事人另有約定，不在此限"這句話會使人產生困惑 因為不可能冠第三人之姓(就變成外遇了)，所以這句話有可能的解釋是不冠夫姓 但是這個法律當時立法的重點是他的目的要知道你結婚了沒 若是有冠夫姓就可辨認出是有結婚 請問我這樣的理解正確嗎? 不知道版上有沒有人可以舉其他利子或是再把目的性解釋說的更詳細一點呢? 謝謝!! -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 218.164.101.162 ※ 編輯: Cranejay 來自: 218.164.101.162 (10/10 00:02)

APEC（亞太經合會）會議剛閉幕，民進黨主席蘇貞昌批評，馬政府將APEC窄化為兩岸政治對話的場域，讓台灣的國際關係「兩岸化」，也讓中國政府乘機在國際場合發表「一中框架」政治宣示，讓台灣被國際誤認為隸屬於中國。

民進黨今天下午舉行中常會，由中國事務部主任洪財隆提出「台灣參與APEC之檢討」專案報告。蘇貞昌說，APEC是少數台灣可參與的國際區域組織，應利用難得機會，和其他國家領袖進行更多交流、對話與互動，為台灣爭取更寬廣的國際空間。

蘇貞昌指出，馬政府心中只有兩岸，對外策略卻毫無國際視野，將APEC窄化為兩岸政治對話的場域；民進黨將透過國會監督等方式，要求馬政府改正，並提出擴大台灣國際參與空間的具體策略。

對於「蕭習會」及「王張會」，蘇貞昌說，台灣是主權獨立國家，依憲法稱為中華民國，台灣前途應由2千3百萬人民以民主程序共同決定；兩岸互動所產生的分歧與問題，絕非國共內戰的延續，台灣前途更非國共兩黨能私相授受。
