越南女被分屍 同鄉老公涉嫌

〔自由時報記者吳俊鋒、劉婉君、黃良傑／綜合報導〕駭人聽聞的台南市仁德分屍案，警方經DNA比對，昨確認死者為28歲越南女子黎氏妙妝，警方懷疑同為越南籍的馮姓丈夫，因感情糾紛而涉殺妻，警帶回馮男及13名外勞關係人偵訊，但馮否認涉案。

警方調查，28歲黎氏妙妝（譯音）與29歲的馮男在越南就是夫妻，育有1女，馮3年前來台工作，相隔1年後黎女也來台，在桃園的餐廳上班，黎女疑因與台灣男同事傳曖昧，3月下旬馮北上將妻帶回台南，黎女被通報逃逸外勞，音訊全無。

棄屍地與夫上班處僅隔一牆

警方查出，馮在仁德區一家泡棉工廠上班，後側圍牆與發現頭顱處僅一牆之隔，加上查訪親友，種種跡象均指向馮男。

專案小組透過國際科刑警查訪，赫然發現越南當地有潛習俗，被害人若是斷手斷頭，冤鬼就沒法向凶手索命，而外勞入境須捺指紋建檔，死者不但被分屍斷頭、斷手，手指頭還全部齊斷，凶手心機很深。

國際刑事科幹員上月赴越南，採集黎氏女兒的毛髮、唾液等生物跡證，由法醫研究所進行DNA比對，昨天「吻合」報告正式出爐。

警方昨持搜索票到工廠帶回馮男，馮男對於妻的死訊很鎮定，面對訊問態度不合作，一概推說「不知道」，也未解釋為何妻失蹤，他卻未報警。

由於凶刀、案發第一現場及其他屍塊均沒有發現，警方試圖突破馮男心防未果，昨晚先將馮男留置，今天再繼續偵訊。

9月11日，仁德區土庫里自行車道附近吳姓住戶蹓狗時，家犬「胖胖」從草叢中叼出右手斷肢前臂，後來警方搜索，又找到左手斷肢前臂，13日胖胖再尋獲女性頭顱，發現這起分屍案。

專案小組公布被害女子的模擬畫像，及牙齒內暴的特徵，黎女的阮姓表姊、同事指認相似度達90%；警方深入調查，馮男將妻帶回台南後，隔天打電話給阮女，說夫妻爭吵後，黎氏不知去向。

但黎氏的頭顱發現處，就在馮男上班的泡棉工廠旁，警正調查馮是否另有租屋處，可能是分屍第一現場。

泡棉工廠台籍幹部表示，馮男到工廠上班3年，話不多，守規矩，近日舉止一如往常，聽聞馮男涉殺妻分屍，非常詫異。

從今年6月開始，勞委會就積極討論擴大勞動基準法的適用對象，也同時將假責任之名、行無須給付加班費之實的責任制納入檢討。而從來不適用勞基法的律師，也在這波討論當中，特別是受雇律師的角色與定位，勞委會在近日也認為應該將受雇律師納入勞基法的規範範圍。但是否採取責任制，則仍須進一步討論。

勞委會同時也表示，「由於律師接案上法庭，難以一般工時規範，納入勞基法後，是否應適用84條之1責任制，後續將再討論。而女性律師懷孕及餵母乳期間，依法不能夜間工作，會建議盡量排除接刑事案件必要性。」

律師的冗長工時

其實會引發「受雇律師是否適用勞基法」，主要就是工時的問題。無論受雇與否、案件性質是什麼，律師的工時其實都很長，因為需要大量的時間研究案情、蒐集並研究適用的法律，以撰擬相關的文件或書狀。

由於台灣的大多數人，對於律師的認知，也僅限於上法院的案件，所以勞委會所考量的律師工時，也是以訴訟律師為主。

但以商務案件來說，律師的工時更長，而對受雇律師來說，通常老闆也不是故意要求受雇律師需要這麼長的工時，而是因為案件性質如此，難以計量確切工時。此由我自身的執業經驗的實際例子（當時仍為受雇律師）來說，就可以略知一二。

【綜合報導】32歲葉姓工人昨在新北市蘆洲區的宿舍上網，想吃泡麵又不想離開電腦螢幕，將攜帶型的卡式瓦斯爐搬進房間煮麵，不慎引燃沖天炮。

據《聯合報》報導，昨上午十時許，葉男正在上網，突然肚子餓想煮泡麵，搬來卡式瓦斯爐，他表示當時房間悶熱，只穿內褲，沒想到竟引燃中秋節沒放完的連發沖天炮，煙火在房內四處亂竄彈射，「我嚇得要命，只好抱著頭、不斷左右跳腳」，胯下被炸得滿是瘀青。

淘寶網賣仿冒品　半年獲利600萬

【陳啟明／桃園機場報導】去年5月20日，航警局與海關從遠雄快遞進口專區中查獲一批仿冒「MONTBLANC」及「OMEGA」名牌手錶6只，經追查貨主後發現，一名因詐欺、侵占遭到通緝的男子黃旭輝（49歲）涉有重嫌，昨天下午前往台中將黃男逮捕歸案，並當場查獲仿冒BEATS耳機339副及仿冒名牌手錶16只，市價高達500萬元。
 
警方表示：蘇嫌除了利用知名大陸拍賣網站「淘寶網」販售仿冒品外，還利用淘寶網對台灣買家購買物品需要繁雜的設定儲值，在網路拍賣上刊登「代辦大陸淘寶網各項業務」甚至還提供兌換人民幣的項目，短短6個月，獲利600萬以上，訊後依違反銀行法、商標法等罪嫌移送地檢署偵辦。
