（以上恕刪，相關討論請參考版友及親屬意見） : : 所以，我提出了我想簽婚前協議 : : 協議內容只有一條 : : "如果兩方有人對婚姻不忠， : 與人搞曖昧出軌或是有不為世俗法律所允許之不當行為， : 其名下所有房產、財產以及孩子的監護權，將無條件歸對方所有" : : : 我不知道，婚前協議的法律效率有多少？ : 也不清楚，這樣的內容足不足以成為約束來保護這段婚姻？ : 更不明白，立下這樣的條約，那麼對婚姻和愛情的信任還有多少？ : 現在的我，到底還能做些什麼，去保護我自己？ : 去捍衛這段岌岌可危的感情？ 婚前協議目前實務的看法如下： （一）婚姻之目的在於永久之結合關係，結婚時男女雙方應認定 其婚姻為永恆，即以終生共同生活之意思而結婚，將此種 期待內容包括與離婚有關之婚前契約，似乎違背婚姻之純 潔之本質。 （二）此種契約有鼓勵離婚之嫌。蓋婚前契約約定後，夫妻可能 因事先了解離婚時，雙方已無有關子女監護或贍養費之爭 議，此無異剝奪一方配偶之權利，創造他方配偶不在乎對 方之有利動機。 （三）參酌最高法院五十年台上字第二五九六號判例，夫妻間為 恐一方日後或有虐待或侮辱他方情事，而預立離婚契約者 ，其契約即與善良風俗有背，依民法第七十二條應在無效 之列。足見實務上亦尚未承認此類契約之效力。 另請參考司法院第 11 期公證實務研究會研究專輯 第 2 則、第3則 法律問題：當事人訂定婚前協議請求公（認）證，協議書中約定 ，如日後雙方離婚， （一）一方得請求贍養費若干， （二）離婚後子女之監護權歸屬於其中一方，問准否公證？ 研究意見： 應予拒絕，蓋婚姻之目的應在長久存續，建立美滿和諧之 家庭，於婚前協議書中訂定離婚之贍養費約定及子女之監 護，實違背我國公序良俗，且國外亦曾發生無法支付預定 之高額贍養費而引發犯罪之案例，故應予拒絕。 小小法律意見希望對您有幫助 另外求助專業心理師傾訴一下，對心理的創傷也很有幫助 希望你早日渡過難關 -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 210.69.124.40
