為解決兩蔣日記爭議，美國史丹佛大學校方決定訴諸法院，由第3方確認兩蔣日記歸屬。

2005年，蔣孝勇遺孀蔣方智怡與史丹佛大學胡佛研究所（Hoover Institution）簽署保管合約，將兩蔣日記交給胡佛研究所保管。不過，此舉卻引起部分蔣家後代不同意見，向史丹佛校方要求處理這些資料，造成兩蔣日記所有權爭議，讓史丹佛大學不堪其擾。

根據中央社報導，為解決兩蔣日記爭議，美國史丹佛大學校方曾多次派人赴台，但仍無法解決。史丹佛大學表示，已向法院遞交訴狀，其主要目的，並非要提告，只是要透過第3方確認日記歸屬，以做處置。

報導指出，兩蔣日記仍在胡佛研究所的檔案館裡，隨時提供學生研究，正本仍保存良好，一般提供的都是影本資料。
