有個題目是這樣的 六歲的甲將零用錢兩千元送給20歲的乙 乙欣然接受 拿兩千向善意的丙購買鍵盤 乙可以向丙請求反還嗎？ 答案是 丙將金錢收下 與自己的錢發生混同 依813條 歸主物所有人丙所有 不得請求返還 我覺得這答案好怪 我以為是948善意受讓 加上951條來解 可是老師說 兩千不是遺失物所以不能用951 但是這兩千難道不算是 非原占有人意思而喪失占有之物嗎？ 想請教這題解法該如何解才對 -- Sent from my Android -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 110.25.7.195
