狗吠就像嬰兒哭　不算噪音免賠

陳姓婦人不堪鄰居飼養的狗叫不停，自行錄音一年，提告向養狗的吳姓夫妻求償10萬元精神慰撫金，不過因無法舉證狗叫聲超過噪音管制標準，法官認定狗叫聲對陳婦影響應不大而駁回。

今日出版的《聯合報》報導，陳婦指控，吳姓夫妻養的小狗，有時從白天叫到隔天清晨，嚴重影響她身心。她向新北市環保局檢舉，但環保局回覆「狗叫聲無法用測音器測」，她自行蒐證一年，提起侵權行為損害賠償訴訟。但因無法舉證狗叫聲超過噪音管制標準，法官認為寵物吠叫就跟嬰兒會哭鬧一樣，聲音難免會傳入鄰家，認定狗叫聲對陳婦影響應不大而駁回。（方翊倩／綜合報導）
