標題[問題] 想請問關於民法日期的計算

大家好 今天在讀民總時 讀到時間記算的時候有疑問 還請版上高手幫忙 感激不盡 題目為 甲於85年3月1日於船難失蹤 請問本案法院為甲之死亡宣告判決 其所確定甲之死亡日期 竟應為民國何年何月何日 我的想法是 先依民法120條2項 以年為計算者始日不計入 因此自85年3月2日起算 又依民法121條2項 不以年之始日起算者 故計算一年後 與起算日相當日之前一日為期間末日 也就是86年3月1日午夜十二點為判決內確定死亡之時 但賴農惟的解答 雖然一樣是86年3月1日 但它引的法條是120條2項和121條1項 請問是不是解答解錯了呢 因為末日的計算 是要以日 月 年的始日起算時 才會用到121條1項 本題以年計算 且不是以該年的始日為計算 那應該是用121條2項啊?? 我的問題除了上述外 另外就是關於121條1項 是不是像我講的一樣 該項是用於月或年計算時 且以該月或年始日起算時才有適用 否則就跳到第二項的計算方法了 或者版友是否有更容易懂的方法 感謝感謝 -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 122.117.6.159
