房客雜物丟馬桶挨告　法官認設計不良判無罪

【蔣永佑／台北報導】林姓男子（44歲）去年5月中向柯姓房東承租北市大同區昌吉街某公寓4樓套房，卻在半個月內陸續將水果果核、果皮、菜葉、茶葉包及保險套等雜物丟入馬桶，以致馬桶嚴重阻塞糞水溢出，甚至導致三樓漏水，房東僱請水電工在水管維修孔挖出雜物，怒告林男毀損。
 
林男聲稱只倒泡麵剩湯進馬桶，懷疑水管設計不良，以致之前房客丟了異物沖不走才造成阻塞，法院傳喚裝修公司員工，查出房東整修房屋重新鋪設污水管線時，卻沒有設計足夠沖力，將林男所住房間馬桶內的雜物沖入排水主幹道。
 
法官認為，一般人生活上多少都會將部分小型垃圾丟入馬桶沖掉，林男不需要故意阻塞房內馬桶，讓自己無法使用，還冒押金被沒收的風險，因此在缺乏證據顯示他惡意堵塞馬桶下，判他無罪。房東得知判決後表示，房子遭污損至今未修復，考慮對林男求償。
