五、甲列乙為被告，起訴請求乙給付新臺幣（下同）50 萬元，主張甲持有丙簽發，票面 金額 50 萬元，付款人為華南銀行，並由乙背書之支票一紙，於票載日期經提示而未獲兌 現，乙應負背書人責任。第一審法院判決甲勝訴，乙不服該判決而上訴於第二審。問第二 審法院就下列訴訟應如何處理？（38 分） （一）甲追加丙為被告，請求丙與乙連帶給付 50 萬元，主張發票人丙應與背書人乙負連 帶責任。 （二）乙主張其對甲有一筆價金債權 200 萬元，用以抵銷甲之系爭票據債權，並就抵銷 餘額提起反訴，請求甲給付 150 萬元。 關於第二題的部分 我有寫到民訴436-1有限制簡易訴訟程序的二審上訴應該不能超過50萬(致須改用通 常程序),所以這題反訴的價額為150萬,與原訴訟50萬加起來應該已經超過簡易訴訟 程序二審可以追加反訴的範圍了吧? 因為高點解答沒有提到這一點,來問問各位高手是不是我那裡想錯了呢? 謝謝! -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 140.112.158.153
