行政院勞委會今(6)日表示，為保障受僱勞工的就業安全，勞工若因雇主欠薪、沒有按時發薪等事由離職，也符合就業保險法規定的非自願離職，可向公立就業服務機構申請相關保險給付。

勞委會表示，就業保險法有關非自願離職之規定，包括勞工因公司關廠、遷廠、休業、解散、破產宣告、歇業、改組、轉讓、虧損或業務緊縮等事由離職外，還包括勞工依勞動基準法第14條與雇主終止勞動契約之情事。

勞委會舉例，如實務上勞工若因雇主欠薪，或是沒有按時發放薪水，而以勞動基準法第14條第1項規定：「雇主不依勞動契約給付工作報酬」、「雇主違反勞動契約或勞工法令，致有損害勞工權益之虞者」為由，與雇主終止勞動契約者，即符合非自願離職要件，可持離職證明，向各地公立就業服務機構申請失業給付。

勞委會說明，依規定參加就業保險的受僱勞工，若面臨非自願離職的失業狀況時，只要符合請領要件，就可以申請相關保險給付，勞工朋友不要忽略自己的權利。
