停在馬路上的機車被撞誰該負責？

鄰居因為每次帶狗尿尿要靠牆，所以不準住戶機車停太靠牆邊，如果太靠牆邊，會私自把機車移到路中間，因為我們這裡剛好是十字路口，常常一轉進來會差點撞上機車，警察又不處理，認為這是鄰居間的問題，昨天對方又把機車移到路中間，剛好我後面也有一台車，我車子轉進來時因為差點撞上機車，所以緊急剎車，後方車差點撞到我，猛對我按喇叭，請問...這種狀況下，如果撞到了，誰該負責？

狗狗尿尿問題已找環保局處理，但對方照樣帶狗尿尿，照樣移機車，找警察沒用，找環保局沒用，找村長沒用~~~才搬來沒多久，再搬家，沒錢:0.0:
