闖紅燈是我不對，但維修費用是否公道呢?

前幾天一個愰神闖了紅燈，撞上了bmw後門車輪
交通處理後，對方聲稱說不進原廠，給我們要省點(超窩心)
後續傳了民間車廠估價單(大驚)21萬多

我先生日前已與車主碰面，
提出我方板金技師到對方車廠評估
本是說好以修復前題處理，(12年車)
但隔日接到訊息，對方要求全新處理
且提出要求代步車費用
請問此案如直接附諸法院即可?

我的車頭撞bmw僅車門單邊潰縮無法開門，
水箱無破損，正常行駛，南投台中跑
估價維修約2萬多
其實該給Toyota altis一個鼓勵，
這一撞歐規多硬..自己明膫

最後是，多保點險，窮人玩不起
