前空軍士兵江國慶遭到刑求、錯殺，國防部在賠償江家後轉向前空軍作戰部司令陳肇敏等求償。台北地院29日判決軍方勝訴，陳肇敏等6人共應賠償5955萬餘元。

1996年間，空軍作戰司令部發生女童被姦殺案，軍方在1997年8月13日槍決被控犯案的江國慶；2010年5月，監察院調查報告指出，當時空軍作戰部司令陳肇敏違反軍事審判法，將全案交由不具軍司法警察身份的反情報總隊調查，且對未涉案的江國慶刑求逼供，無視許姓士兵自承犯案的自白，迅速將江國慶槍決，枉顧司法人權。江案在軍事法院再審後改判無罪，國防部依法補償江家約新台幣1億3000多萬元，並聲請假扣押陳肇敏等財產。

國防部北部地方軍事法院向台北地院提起民事訴訟，法院開庭時，被告都委由律師出庭，並強調是指示依法辦理，未要求刑求，國防部求償已超過時效等事由抗辯。不過，台北地方法院仍判決陳肇敏等6人共應賠償國防部5955萬餘元。
